The paper reports another case where a judge, Milwaukee County Circuit Judge Thomas Donegan, is responsible for a murder.

The Milwaukee Police Department keeps catching these thugs, but judges like Judge Thomas Donegan doesn’t think drug & gun crimes, including armed robbery are serious.

Judge Donegan had the opportunity to put these thugs away for long prison terms, up to 40 years, but at one sentencing, he said:

“If I think you are a danger to the community, I have no right to let you out there,” Donegan told Drew (Antoine Drew Jr.) during sentencing in December, according to the transcript. “I am coming down on the side that I think you are not likely to repeat this offense.”

Judge Donegan was wrong, and it was a deadly mistake. A few months later, Antoine Drew Jr. shot one of his accomplices, Clemmie L. Johnson, during an attempted armed robbery. Johnson died from the gunshot wound. Yes, it was another thug that died, that’s better than an innocent victim, but if Judge Donegan was doing his job and protecting the public, Antoine Drew Jr. would have been in prison, instead, Milwaukee County Circuit Judge Thomas Donegan, has blood on his hands.

    This is why elections are important. Most judges start out as appointees by the governor, and then (usually) run unopposed at the next term. Unless they’re found to be licentious drunks (Frank Crivello) or wack-jobs (Jackie Schellinger) they stick around forever, whether they’re criminal friendly or not…if they’re independent (Robert Crawford) they get chased out. If they manage to loose an election (Russell Stamper) they just get ‘appointed’ to do permanent reserve judge work and nothing changes.

    But in the final analysis this isn’t just a failure of the courts - Drew had probation agents, neighbors, friends, family, associates - none of whom were able to affect his attitudes and behavior, probably because they either didn’t care or ‘enabled’ his criminal thinking. And despite what some think of her, Robin Shellow was entirely right when she presented the “urban psychosis” theory - but she had it backwards - it’s not a mitigating factor but an aggravating factor. And the inner city is flooded with feral, psychotic children, teens, and convicts…

    But DOC is also at fault - Doyle was responding to pressure from this department to ease the inmate load (he did have the last word, though), and this filters down to the courts.

    We have a choice. Now go make one (several, actually) on Tuesday.

    I echo the sentiment expressed by A Nonymouse. As I wrote on the Friday Open Line thread, Donegan is a long time Lefty who came from the Public Defender ranks if memory serves me correctly. (That in itself should endear him to Gina Barton.) As a Judge, he has cared more about thugs (as does Gina Barton) than about the decent people and has abused his authority time after time (which I’m sure Gina Barton would have a hard time figuring out). The Journal Sentinel definitely picked the right Judge to focus their attention and obviously understood the need NOT to assign Gina Barton to this project. Diedrich and Haggerty could probably write volumes similar to this story if they researched his time on the Bench.

    Considering the Leftist leanings of at least one Probation Officer we’ve heard from here, it doesn’t surprise me that old Drew continued on his merry way without getting his Probation chain yanked. Just another example of those within the so-called Criminal Justice System who really don’t give a damn about the decent people.

    My differences with Ed Flynn’s policing strategy aside, I applaud him for speaking out on this travesty and calling Donegan’s failure out in this article. It is what any Police Chief should do.

    That said I found it disturbing, but not really a surprise, that thugs are still being caught and almost immediately released with Municipal Citations by MPD. Unless the procedure has been rewritten since I left, there are a sufficient number of criteria to merit summary arrests and holds until the next regularly scheduled court date in the MPD’s Standard Operating Procedures Manual. I say not really a surprise because even when I was still with MPD there were a significant number of mid-upper level supervisors who refused to hold thugs in their District jails and ship them down to the City Jail for detention as they were authorized to do. That is indicative to me of people who are promoted way beyond their ability and certainly of people who have no comprehension of what it takes to reduce crime.

    This is a classic case identifying BREAKDOWNS on every level of the Criminal Injustice System but certainly at the highest levels where something could have been done to prevent additional crimes, including murder, if a Judge had just been more concerned about good people than about some demented LEFTIST social agenda he has always had.
