The Milwaukee Election Commission (pictured on the right) have now rescinded it’s own decision to allow the McJr recall to go forward. This comes after the State Elections Board (in the pocket of Mike Maistelman) basically gave them a chance for a do-over.
So the Keystone Elections Commission will have some meetings to decide what to do in future meetings that they may meet to discuss past meetings…
McGee recall formally rescinded
The Milwaukee Election Commission today formally rescinded its vote to allow a recall election against Ald. Michael McGee but said it would meet again Feb. 12 to reconsider its earlier decision.
The panel is to meet again before that date to determine how it should proceed, including whether it would take additional testimony on petition signatures or simply review its earlier decision based on six hours of line-by-line testimony and five hours of closed-door discussions.
At today’s meeting, attorneys for McGee and recall organizer ViAnna Jordan both raised concerns about how the matter will proceed. McGee’s side wants additional testimony, as it did not at the first hearing provide enough evidence of fraud or irregularities to block the election.
Jordan’s side, meanwhile, argued today that based on a state Elections Board move last week, the city panel must simply re-do its earlier decision, but this time in public. That is, it cannot reopen the matter for more testimony.
Meanwhile, candidates who began circulating nomination papers can still turn them in by tomorrow’s deadline. The Feb. 20 election was cancelled by today’s action. If they have enough signatures, they will be placed on the ballot if a recall ultimately proceeds.
The panel plans to let the elections staff, with input from the city attorney’s office and the state Elections Board staff, develop a proposed procedure for the Feb. 12 meeting. That could include a provision to allow the commission to subpoena witnesses.
After the initial hearing Jan. 2, the panel said it had found evidence of “widespread fraud” in the petition gathering process, but nevertheless had identified enough valid signatures to force a recall. McGee appealed that decision to the state Elections Board, where members of the commission appeared last week and renounced their earlier finding.

President Hugo Chavez told U.S. officials to “Go to hell, gringos!” and called U.S. Secretary of State Condoleezza Rice “missy” on his weekly radio and TV show, lashing out at Washington for what he called unacceptable meddling in Venezuelan affairs.
Sunday’s comments by the fiery leftist were in response to Washington’s criticism of a measure to grant Chavez broad lawmaking powers. The National Assembly, which is controlled by the president’s allies, is expected to give final approval this week to an “enabling law” that gives Chavez the authority to pass laws by decree for an 18-month period.
